A woman who pleaded guilty to bestiality for performing a sex act with a dog to please her male lover has had her conviction set aside.
The woman, who cannot be named for
legal reasons, had struck up sexually loaded chats with the man over the
internet before they met up.
During their eventual tryst, he
persuaded her to let him film her sexually interacting with a dog before she
told him to stop.
The woman pleaded guilty to
bestiality in May 2014, with a judge deciding to record a conviction in the
community's interests.
He noted the then-university
student's desire to work with disadvantaged kids and her apparent
susceptibility to manipulation.
But the Queensland Court of Appeal
on Tuesday found the judge made a mistake as to the magnitude of that risk.
'The applicant is a young woman who
made a very poor choice which she plainly regrets,' Justice David Jackson
observed.
'Her ill-conceived and tawdry sexual
adventure has resulted in some public embarrassment and other consequences
associated with being prosecuted for an indictable offence.'
He noted the young woman didn't seem
to get any sexual gratification from the act, and rather, sought to accommodate
her lover's perverse tastes.
This was supported by his colleagues
on the Court of Appeal's three-judge panel.
